Terms of Service

The terms that govern use of the JamEMR public website, including permitted use, intellectual property, disclaimers, and liability. The JamEMR clinical product is governed by separate written agreements.

These Terms of Service (“Terms”) govern your use of the public website of JamEMR [legal entity name pending] (“JamEMR,” “we,” “us”) at jamemr.com (the “Site”).

1. Acceptance of These Terms

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. The Site Is Not the Clinical Product

The Site provides general information about JamEMR and a way to contact us. Use of the JamEMR clinical product is governed by separate written agreements, including pilot agreements, service agreements, and Business Associate Agreements with covered entities. These Terms do not grant any right to use the clinical product, and nothing on the Site creates such an agreement.

3. Permitted Use

You may use the Site for lawful, informational purposes. You agree not to:

  • Interfere with or disrupt the Site or the systems that serve it;
  • Attempt to gain unauthorized access to any part of the Site;
  • Scrape, harvest, or collect information from the Site by automated means beyond what standard search engines perform;
  • Use the Site to transmit malicious code or unlawful, infringing, or misleading content;
  • Misrepresent your identity or affiliation when contacting us.

4. No Patient Information Through the Site

The Site’s contact and demo forms are for general business inquiries only. Do not submit patient information or protected health information (PHI) through the Site. If we receive PHI unsolicited, we will delete it promptly, as described in our Privacy Policy.

5. Intellectual Property

The Site and its content — including text, graphics, logos, and design — are owned by JamEMR or its licensors and are protected by intellectual property laws. You may view and print Site content for your own informational use. Any other reproduction, distribution, or creation of derivative works requires our prior written permission. “JamEMR” and associated marks may not be used without our consent.

6. Informational Content; Not Medical Advice

Content on the Site is general information about our company and products. It is not medical advice, and it is not a substitute for the professional judgment of qualified clinicians. Descriptions of product capabilities may include features that are planned or under development (roadmap items) and are subject to change without notice.

7. No Warranty

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the Site will be error-free or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, JamEMR will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Site. To the extent any liability cannot be excluded, our total aggregate liability arising from the Site will not exceed one hundred US dollars (USD 100) or the minimum amount permitted by applicable law, whichever is greater. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

The Site may contain links to third-party websites. We do not control and are not responsible for their content, policies, or practices. Linking does not imply endorsement. Your use of third-party sites is at your own risk and subject to their terms.

10. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “last updated” date. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which JamEMR is established, to be finalized in legal review ([Jurisdiction — pending legal review]), without regard to conflict-of-laws principles.

12. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
